A trademark registered in Turkey can be protected abroad in the same way. Registration is a prerequisite for protection to begin. Therefore, companies or individuals operating outside of Türkiye, or planning to start operations outside of Turkey, should register their brands abroad.
If your brand is registered by someone else in the country you are exporting to, there is a risk of “goods being seized at customs”.
There are various ways to register a trademark abroad. These;
• Country-specific applications made separately in the countries where registration will be made in the classical sense. • Community application (CTM) providing registration in European Union countries. • Application made within the framework of the Madrid Protocol, of which 92 countries, including Turkey, are members.
Trademark registration will be required for obtaining permits from official institutions in the countries to which exports will be made (food production certificate, pharmaceutical certificate, etc.).
