Today, trademark owners can achieve well-known trademark status by submitting an application to the Turkish Patent Institute for “determination of well-known status”.
It is not possible to register an identical or similar mark to a well-known mark in any other class. The Turkish Patent Institute rejects any mark that is identical or similar to a well-known mark ex officio, without the need for the trademark owner to file an objection. It is easier for holders of well-known trademark rights to prove infringement of their trademark rights and to demonstrate bad faith on the part of someone attempting to counterfeit their mark in a potential lawsuit.
